TITLE: Ordinance 80-23 Set Public Hearing for November 1, 2023 ORDINANCES AND RESOLUTIONS: WHAT THE ORDINANCE ACCOMPLISHES: An ordinance amending the City of Cape Coral, Florida, Land Development Code, Article 5, “Development Standards,” Chapter 2, “Accessory Structures,” by amending Section 5.2.1., “General Requirements,” regarding marine improvements and boat canopies; and Article 5, “Development Standards,” Chapter 4, “Marine Improvements,” by amending Section 5.4.1., “Purpose and Intent,” regarding the construction of marine improvements and boat canopies. SUMMARY EXPLANATION AND BACKGROUND:

Ordinance 80-23 amends sections of the Land Development Code (LDC) pertaining to accessory structures and marine improvements. These changes collectively will allow property owners to obtain permits for marine improvements and boat canopies on residential sites without a primary structure, like a single-family building. This code change amends to LDC to allow these improvements to occur on vacant residential sites, similar to that which was allowed under the former Land Use and Development Regulations. This change was discussed with the City Council on August 23 at a Committee of the Whole Meeting. Both City staff and the Planning and Zoning Commission recommend approval of this ordinance
