WHAT THE ORDINANCES ACCOMPLISHES:

An ordinance of the Mayor and City Council of the City of Cape Coral, Florida, amending the Land Development Code of the City of Cape Coral, Florida, Article 6, Parking, Chapter 2, Truck and Vehicle Parking, Section 6.2.1, Parking Regulations for Residential Zoning Districts, regarding parking on property with a principal residential building.  (Brought forward by City Management)

NOTE:  Regulates parking of vehicles based on principal use of the structure.



REQUESTED ACTION: 
Introduction
SUMMARY EXPLANATION AND BACKGROUND:

Ordinance 70-24 amends Article 6, Chapter 2 of the Land Development Code (LDC), entitled “Truck and Vehicle Parking.” Currently, trailers and commercial vehicles are prohibited from being parked on property with a principal residential building located within the R-1, RE, RML, and RMM Districts. However, owners of sites with commercial or mixed-use zoning that are improved with residential buildings are allowed to park trailers and commercial vehicles on their sites. This amendment would rectify this inconsistency that exists in the LDC that treats owners of residential buildings differently with respect to commercial parking standards based solely on the zoning of the site. This proposed LDC amendment is intended to provide greater protection to residential areas and property values by prohibiting trailer and commercial parking on all sites that are improved with single-family homes, duplexes, and multi-family buildings.
